Re: SB608 – Workers' Compensation - Temporary Total Disability - Incarcerated Employees - Support

 

Dear Senator Middleton:

SB608 would provide that an employer or insurer is not liable for temporary total disability payments to a covered employee while the employee is incarcerated. In addition it would provide for a specified exception, and apply the Act prospectively.

The Legislative Committee of the Carroll County Chamber of Commerce supports this bill. Since prisoners have removed themselves from the labor market and would not earn wages absent their work injury, there is no reason they should collect wage loss benefits while incarcerated.

We therefore ask that your committee give this bill a favorable report.
